_Introducción_: la Limitación del Esfuerzo Terapéutico (LET) busca reorientar las medidas del acompañamiento terapéutico durante el final de la vida; actualmente existe legislación sobre este tema. _Objetivo: _caracterizar el conocimiento y la claridad conceptual y jurídica del personal de salud del Hospital de San José (HSJ) de Bogotá sobre la LET. _Métodos: _estudio descriptivo transversal usando encuesta de libre preparación. Se estableció claridad conceptual con resultado superior al 70% de respuestas correctas. Datos levantados con cuestionario de selección múltiple vía Formularios (...) Google, tabulados en Microsoft Excel ® y analizados con Stata ® vía estadística descriptiva. _Resultados:_ 36 % de encuestados tuvo claridad conceptual y jurídica sobre LET; el 82,3 % de encuestados diferenciaron LET de eutanasia y el 95,6 %, LET de cuidados paliativos. El 61 % de los encuestados no tuvo conflicto moral/jurídico con LET; el 60 % y el 70 % de los encuestados creen, respectivamente, que suspender el oxígeno y la ventilación mecánica no hacen parte de la LET. Finalmente, el 78,9 % expresó no haber recibido suficiente información sobre el tema. _Conclusiones_: el personal encuestado carece de claridad conceptual suficiente sobre la LET,lo que señala la necesidad de mayor educación al respecto. Through the analysis of concepts and comparison with the original sources, this article analyzes and evaluates Mario Teodoro Ramírez’s interpretive approach on the analogies between the epistemological and the political-ethical thinking of Luis Villoro. Although there are diverse elements that must be rejected, superseded or reformulated, and notwithstanding the numerous precisions required in order to avoid a misinterpretation, the article concludes that the approach is correct in general terms and that it sheds light on the systematic unity of that (...) thinking and its deep spirit. Making visible the complex articulation of the main concepts in Villoro’s Epistemology and Political theory, the article contributes to a better understanding of the philosophy of this thinker, and with it, to the current reflection on the nexus between knowledge, ethics and politics. This article assesses an assumption pervasive in one strain of arguments in favor of stringent immigration controls. The assumption affirms that—for the case of regular admissions—to a certain extent states are permitted to prioritize the interests of their citizens and residents by issuing exclusionary immigration policies (call this the priority assumption). Using the normative methodology of applied international ethics, I suggest some broad constraints to this priority assumption that have a bearing on justifications for current practical immigration policy in Europe, (...) North America, and beyond. I do so by redefining borders as domestic-international institutions that open up borders not only to (internal) standards of justice but also to standards of international legitimacy. (shrink)

The debate about justice in immigration seems somehow stagnated given that it seems justice requires both further exclusion and more porous borders. In the face of this, I propose to take a step back and to realize that the general problem of borders—to determine what kind of borders liberal democracies ought to have—gives rise to two particular problems: first, to justify exclusive control over the administration of borders (the problem of legitimacy of borders) and, second, to specify how this control (...) ought to be exercised (the problem of justice of borders). The literature has explored the second but ignored the first. Therefore, I propose a different approach to the ethics of immigration by focusing on concerns of legitimacy in a three-step framework: first, identifying the kind of authority or power that immigration controls exercise; second, redefining borders as international and domestic institutions that issue that kind of power; and finally, considering supranational institutions that redistribute the right to exclude among legitimate borders. This paper’s main contention is that some basically methodological developments in science which are apparently distant and unrelated can be seen as part of a sequential story. Focusing on general inferential and epistemological matters, the paper links occurrences separated by both in time and space, by formal and representational issues rather than social or disciplinary links. It focuses on a few limited aspects of several cognitive practices in medical and biological contexts separated by geography, disciplines and decades, but connected by (...) long term transdisciplinary representational and inferential structures and constraints. The paper intends to show a given set of knowledge claims based on organizing statistically empirical data can be seen to have been underpinned by a previous, more familiar, and probably more natural, narrative handling of similar evidence. To achieve that this paper moves from medicine in France in the late eighteenth and early nineteenth century to the second half of the nineteenth century in England among gentleman naturalists, following its subject: the shift from narrative depiction of hereditary transmission of physical peculiarities to posterior statistical articulations of the same phenomena. Some early defenders of heredity as an important causal presence in the understanding of life adopted singular narratives, in the form of case stories from medical and natural history traditions, to flesh out a special kind of causality peculiar to heredity. This work tries to reconstruct historically the rationale that drove the use of such narratives. It then shows that when this rationale was methodologically challenged, its basic narrative and probabilistic underpinings were transferred to the statistical quantificational tools that took their place. It has been suggested that due to AI-technology-generated gadgets, a digital unconscious enables the probable annulment of the Freudian unconscious. The purpose of this article is to delve into Freudian topography as a way to demonstrate that this foreclosure of the unconscious was somewhat present in Freud as of 1920. In addition, regardless of solid attempts at the extinction of the unconscious by contemporary demands, I will focus on how the capitalist discourse and AI-generated technology propose a different form of (...) social bond. Finally, the conceptualization of pain (_Schmerz_) is important for ascribing a different modality to the Freudian unconscious than in recent dissertations, but most importantly, it is a significant element for analytical experience to function properly where it must not be aligned with suffering. An era without an unconscious may foretell a time where enjoyment, as a form of subjectivity, is effaced. (shrink)

Scientific misconduct obstructs the advance of knowledge in science. Its impact in some disciplines is still poorly known, as is the frequency in which it is detected. Here, I examine how frequently editors of ecology and evolution journals detect scientist misconduct. On average, editors managed 0.114 allegations of misconduct per year. Editors considered 6 of 14 allegations (42.9%) to be true, but only in 2 cases were the authors declared guilty, the remaining being dropped for lack of proof. The annual (...) rate of allegations that were probably warranted was 0.053, although the rate of demonstrated misconduct was 0.018, while the rate of false or erroneous allegations was 0.024. Considering that several cases of misconduct are probably not reported, these findings suggest that editors detect less than one-third of all fraudulent papers. (shrink)

The historical background of the 19th century electromagnetic theory is revisited from the standpoint of the opposition between alternative approaches in respect to the problem of interactions. The 19th century electrodynamics became the battle-field of a paramount importance to test existing conceptions of interactions. Hertz’s experiments were designed to bring a solid experimental evidence in favor of one of them. The modern scientific method applied to analyze Hertz’s experimental approach as well as the analysis of his laboratory notes, dairy and (...) private letters show that Hertz’s ‘‘crucial’’ experiments cannot be considered as conclusive at many points as it is generally implied. We found that alternative Helmholtz’s electrodynamics did not contradict any of Hertz’s experimental observations of transverse components as Maxwell’s theory predicted. Moreover, as we now know from recently published Hertz’s dairy and private notes, his first experimental results indicated clearly on infinite rate of propagation. Nevertheless, Hertz’s experiments provided no further explicit information on non-local longitudinal components which were such an essential feature of Helmholtz’s theory. Necessary and sufficient conditions for a decisive choice on the adequate account of electromagnetic interactions are discussed from the position of modern scientific method. (shrink)

This article examines fashion models as gender myths and cultural iconsthrough a cultural history of modelling. It reveals the construction of models’ personas by the successive addition of meaningful signs:physique, manner, attitude, nationality, class, race, salary, chameleonism, slenderness and so on. On the basis of empirical material on models’ experiences gathered from interviews, secondary oral sources and autobiographical material, the author approaches models’ bodies, identities and public personas as artefacts performed through the reiteration of collectively defined gender standards and practices. The philosophical model of constellation has been applied to contemporary musical form, but it reveals too many limitations when confronted with late Adorno’s model of informal music. Once the component of heteronomy, in hierarchical and centered structures of traditional music, has been overcome, it reemerges in the opposite type, the decentered, non-hierarchical or free structures, between the opposites of serialism and aleatoric music. Therefore, the model of informal music, as an "image of freedom", pursues the realization of a musical-aesthetic nominalism (...) that is subtracted from all forms of heteronomy, ancient or modern. La utilización de la radio de manera planificada e intencionada en el proceso educativo contribuye a que los jóvenes adquieran una amplia gama de conocimientos referidos a diversos temas académicos, científicos y humanísticos, de una manera interactiva y vivencial. Partiendo de esta premisa es posible inferir que la radio constituye un recurso útil y valioso para consolidar competencias para la convivencia social en los estudiantes de educación media. Es por ello que el objetivo de este estudio es proponer el uso (...) de la radio como un recurso tecnológico pertinente para la asimilación de competencias para la convivencia social. Para alcanzar el objetivo propuesto el trabajo se enmarca en una investigación de tipo documental. Los resultados del estudio evidencian que la incorporación de la radio a la dinámica de trabajo pedagógico es potencialmente útil en la estimulación de competencias para la convivencia social, fortaleciendo significativamente aptitudes afectivas y morales como la igualdad, el respeto, el trabajo colaborativo y en equipo, la solidaridad, entre otros, además de propiciar en el estudiante el mejoramiento de sus habilidades para la expresión oral y escrita. Close insight into mathematical and conceptual structure of classical field theories shows serious inconsistencies in their common basis. In other words, we claim in this work to have come across two severe mathematical blunders in the very foundations of theoretical hydrodynamics. One of the defects concerns the traditional treatment of time derivatives in Eulerian hydrodynamic description. The other one resides in the conventional demonstration of the so-called Convection Theorem. Both approaches are thought to be necessary for cross-verification of the standard (...) differential form of continuity equation. Any revision of these fundamental results might have important implications for all classical field theories. Rigorous reconsideration of time derivatives in Eulerian description shows that it evokes Minkowski metric for any flow field domain without any previous postulation. Mathematical approach is developed within the framework of congruences for general four-dimensional differentiable manifold and the final result is formulated in form of a theorem. A modified version of the Convection Theorem provides a necessary cross-verification for a reconsidered differential form of continuity equation. Although the approach is developed for one-component (scalar) flow field, it can be easily generalized to any tensor field. Some possible implications for classical electrodynamics are also explored. En el presente artículo, se comienza señalando cómo ambos movimientos difieren significativamente respecto a la herencia del humanismo. Posteriormente, se aborda la noción transhumanista de la ‘libertad morfológica’ de la mano de More, Sandberg y Bostrom. A continuación, se presentan casos paradigmáticos de modificaciones corporales mediante implantes cibernéticos. En último lugar, se problematizan las cuestiones de la identidad, la corporalidad (...) y el desencuentro entre ambas corrientes respecto al ‘volcado de la mente’. -/- Transhumanism and philosophical posthumanism have paid special attention to human corporeality in relation to technological breakthroughs. This article begins by pointing out how the two movements differ significantly about the inheritance of humanism. Subsequently, the transhumanist notion of ‘morphological freedom’ is addressed from the proposals of More, Sandberg, and Bostrom. Then, paradigmatic cases of body modifications through cybernetic implants are considered. This paper argues that our modern concept of biological heredity was first clearly introduced in a theoretical and practical setting by the generation of French physicians that were active between 1810 and 1830. It describes how from a traditional focus on hereditary transmission of disease, influential French medical men like Esquirol, Fodéré, Piorry, Lévy, moved towards considering heredity a central concept for the conception of the human bodily frame, and its set of physical and moral dispositions. The notion of heredity (...) as a natural force, with a wide ranging capabilities of transmitting differentially both fundamental and accidental characters was generalized by that generation of physicians with the help of contemporary naturalists and physiologists. By 1830 the term hérédité was widespread, and it shared the explanatory and semantic qualities of traditional medical concepts like constitution and temperament. An analysis is given of the main developments that led to the conception of biological (including human) bodies as consisting of a layered, hierarchical organization of characters, differentially affected by the laws of conservation (Heredity) and change (Inneity, Variation). The mid-century work of the French physician Prosper Lucas, Traité Philosophique et Physiologique de L'Hérédité Naturelle, is shown to be the culmination of the efforts of several generations of French physicians towards having a feasible, complexly structured notion of how heredity works. In their recent article, Brown et al analyse several ethical aspects around immunity passports and put forward some recommendations for implementing them. Although they offer a comprehensive perspective, they overlook two essential aspects. First, while the authors consider the possibility that immunological passports may appear to discriminate against those who do not possess them, the opposite viewpoint of immune people is underdeveloped. We argue that if a person has been tested positive for and recovered from COVID-19, becoming immune to it, (...) she cannot be considered a hazard to public health and, therefore, the curtailment of her fundamental rights is not legitimate. Second, they omit that vaccine distribution will create similar problems related to immunity-based licenses. Vaccine certificates will de facto generate a sort of immunity passport. In the next phases of the pandemic, different immunity statuses will be at stake, because the need to identify who can spread COVID-19 is unavoidable. If a person does not pose a threat to public health because she cannot spread the infection, then her right to freedom of movement should be respected, regardless of how she acquired that immunity. Erick J. Ramirez, Miles Elliott and Per‑Erik Milam (2021) have recently claimed that using Virtual Reality (VR) as an educational nudge to promote empathy is unethical. These authors argue that the influence exerted on the participant through virtual simulation is based on the deception of making them believe that they are someone else when this is impossible. This makes the use of VR for empathy enhancement a manipulative strategy in itself. In this article, we show that Ramirez et al.’s ethical (...) rejection of empathy enhancement through VR is based on confusion. First, we show that this misunderstanding stems from the conception of empathy-enhancing simulations solely as failed attempts at “being someone else,” along with ignoring the crucial difference between the psychological perspective-taking processes of imagine-other and imagine-self. Then, having overcome that misconception, we argue that the ethical misgivings about the use of VR to promote empathy should disappear and that these projects have greater potential for behavioural change than purely sympathy-focused interventions. The application of Artificial Intelligence (AI) in healthcare and epidemiology undoubtedly has many benefits for the population. However, due to its environmental impact, the use of AI can produce social inequalities and long-term environmental damages that may not be thoroughly contemplated. In this paper, we propose to consider the impacts of AI applications in medical care from the One Health paradigm and long-term global health. From health and environmental justice, rather than settling for a short and fleeting green honeymoon between (...) health and sustainability caused by AI, it should aim for a lasting marriage. To this end, we conclude by proposing that, in the upcoming years, it could be valuable and necessary to promote more interconnected health, call for environmental cost transparency, and increase green responsibility. Nevertheless, it is possible to interpret the wave-function as a multi-field in three-dimensional space. This approach hasn’t received the attention yet it really deserves. Predictivists use the no miracle argument to argue that “novel” predictions are decisive evidence for theories, while mere accommodation of “old” data cannot confirm to a significant degree. But deductivists claim that since confirmation is a logical theory-data relationship, predicted data cannot confirm more than merely deduced data, and cite historical cases in which known data confirmed theories quite strongly. On the other hand, the advantage of prediction over accommodation is needed by scientific realists to resist Laudan’s criticisms of the (...) no miracle argument. So, if the deductivists are right, the most powerful argument for realism collapses. There seems to be an inescapable contradiction between these prima facie plausible arguments of predictivists and deductivists; but this puzzle can be solved by understanding what exactly counts as novelty, if novel predictions must support the no miracle argument, i.e., if they must be explainable only by the truth of theories. Taking my cues from the use-novelty tradition, I argue that (1) the predicted data must not be used essentially in building the theory or choosing the auxiliary assumptions. This is possible if the theory and its auxiliary assumptions are plausible independently of the predicted data, and I analyze the consequences of this requirement in terms of best explanation of diverse bodies of data. Moreover, the predicted data must be (2) a priori improbable, and (3) heterogeneous to the essentially used data. My proposed notion of novelty, therefore, is not historical, but functional. Hence, deductivists are right that confirmation is independent of time and of historical contingencies such as if the theorist knew a datum, used it, or intended to accommodate it. Predictivists, however, are right that not all consequences confirm equally, and confirmation is not purely a logical theory-data relation, as it crucially involves background epistemic conditions and the notion of best explanation. Conditions (1)–(3) make the difference between prediction and accommodation, and account for the confirming power of theoretical virtues such as non ad-hocness, non-fudging, non-overfitting, independence and consilience. I thus show that functional novelty (a) avoids the deductivist objections to predictivism, (b) is a gradual notion, in accordance with the common intuition that confirmation comes in degrees, and (c) supports the no miracle argument, so vindicating scientific realism. In jurisprudential literature, the adjective 'defeasible' appears as a predicate of many terms: concepts, laws, rules, reasoning, justification, proof, and so on. In this paper, we analyze the effects of some versions of the thesis of the defeasibility of legal norms on the reconstruction of the notion of legal validity. We analyze some possible justifications of this thesis considered as a claim concerning validity, and enquire into two possible sets of problems related to the defeasibility of the criteria of identification (...) of a legal system. We also provide a formalization of some options regarding defeasible criteria of identification, which can be used as a tool for meta-jurisprudential analysis. Informed by an ontological and phenomenological approach, and building mainly, but not exclusively, on the thought of Sartre, Daniel Rueda Garrido considers the concept of a ""form of life"" as a term that bridges the gap between subjective identity and communities.

We show that data collected from corpuses of documents violate the Clauser-Horne-Shimony-Holt version of Bell’s inequality and therefore indicate the presence of quantum entanglement in their structure. We obtain this result by considering two concepts and their combination and coincidence operations consisting of searches of co-occurrences of exemplars of these concepts in specific corpuses of documents. Measuring the frequencies of these co-occurrences and calculating the relative frequencies as approximate probabilities entering in the CHSH inequality, we obtain manifest violations of the (...) latter for all considered corpuses of documents. In comparing these violations with those analogously obtained in an earlier work for the same combined concepts in psychological coincidence experiments with human participants, also violating the CHSH inequality, we identify the entanglement as being carried by the meaning connection between the two considered concepts within the combination they form. We explain the stronger violation for the corpuses of documents, as compared to the violation in the psychology experiments, as being due to the superior meaning domain of the human mind and, on the other side, to the latter reaching a broader domain of meaning and being possibly also actively influenced during the experimentation. We mention some of the issues to be analyzed in future work such as the violations of the CHSH inequality being larger than the ‘Cirel’son bound’ for all of the considered corpuses of documents. This article tries to clarify the contrast between the contemporary tourist figure and the romantic traveler. From a conceptual and theoretical framework, it is our aim to establish a critical apparatus to problematize the influence of new media in the experience of travel nowadays, as a part of the Industry of Culture. From categories of analysis such as the unexpected, the travel as a personal transformation or the authenticity, our essay deals with a critical perspective of the hyperconnected tourist, specially (...) through the smartphone, from the point of view of the ideals of the romantic traveler and the Grand Tour. We model a piece of text of human language telling a story by means of the quantum structure describing a Bose gas in a state close to a Bose–Einstein condensate near absolute zero temperature. For this we introduce energy levels for the words (concepts) used in the story and we also introduce the new notion of ‘cogniton’ as the quantum of human thought. Words (concepts) are then cognitons in different energy states as it is the case for photons in different (...) energy states, or states of different radiative frequency, when the considered boson gas is that of the quanta of the electromagnetic field. We show that Bose–Einstein statistics delivers a very good model for these pieces of texts telling stories, both for short stories and for long stories of the size of novels. We analyze an unexpected connection with Zipf’s law in human language, the Zipf ranking relating to the energy levels of the words, and the Bose–Einstein graph coinciding with the Zipf graph. We investigate the issue of ‘identity and indistinguishability’ from this new perspective and conjecture that the way one can easily understand how two of ‘the same concepts’ are ‘absolutely identical and indistinguishable’ in human language is also the way in which quantum particles are absolutely identical and indistinguishable in physical reality, providing in this way new evidence for our conceptuality interpretation of quantum theory.
